Speed programs
Local street speed enforcement is a closed pilot
The pilot
California authorized a speed safety system pilot through Assembly Bill 645, limited to a defined list of cities, with Malibu added by later legislation. Cities outside that list are not authorized to deploy speed cameras while the pilot runs.
The practical effect for a new entrant is that the pilot cities have already run their procurements. Our position in California on this category is preparing for what comes after the pilot, and supporting cities that want to seek their own authority.
Work zones
Assembly Bill 289 created a separate state highway work zone speed safety program, on state highways rather than local streets, with a capped number of systems and enforcement conditioned on crews being present.
This is the open category in California today, and it is where we are focused.
Data protection
California has an ALPR statute, and it has a publication requirement
The usage and privacy policy
California's ALPR provisions in the Civil Code require an operator to maintain reasonable security practices and to implement a usage and privacy policy. That policy has to be available to the public in writing and, where the operator has a website, posted conspicuously on it.
The statute sets out a minimum content list, including the authorized purposes, which job titles may access the system, how compliance is monitored, the rules on sharing, who the responsible custodian is, how accuracy is maintained, and the retention period with the destruction process.
What it means in practice
For a buyer, this is useful rather than burdensome: the statute tells you exactly what to ask a vendor for. If a vendor cannot show you a published policy covering those points, that is information.
